In Design/Build, One Person Is Responsible

If you hire one contractor to build a room addition or some other home improvement project, that contractor is responsible for all the work done — and any and all construction defects that may occur.

When a construction project has problems, it can be difficult for a homeowner to know who or what caused the problems. The advantage of a design/build contract is that there is one person who is accountable to the homeowner. At the Law Offices of Edward C. Traditional construction projects have divided responsibilities.

The owner of the project (the homeowner) may hire an architect to design the project. Then the owner may hire a contractor to build the project. If something goes wrong, it can be difficult to decide who was responsible. Each party may blame the other.

In design/build contracts, the design/builder has full responsibility.

The design/builder cannot shift responsibility to anyone else. The design/builder is responsible for all work, including subcontractors and material suppliers. The builder is also responsible for meeting time and cost agreements.
